If he wasn't going to cover up the mineral sites ahead of time, why on earth would he call the local game warden and a week before he was going to start hunting and ask him what he should do about the two mineral sites?

Agreed! ^^ Again, I am not close enough to this situation to say anything from a factual standpoint. But, with what has now been revealed publicly AND the response written by Chris(Sureshot), a very reputable person, explaining the sequence of events...why is anyone still sticking up for the LEO and/or the County Attorney here?

This seems like a pretty clear cut case of over zealous prosecution and/or some sort of law enforcement blunder. It does seem as though some cannot let it go and allow this man to enjoy his trophy...which certainly appears to have been legally and ethically harvested IMO.

I understand why some would have legitimate doubt about the circumstances immediately following the announcement of the confiscation and charges, as few people really knew the facts of the story at that time. But now, with the info that is out there that totally clears the man IMO, what are you holding onto folks? Check yourself.
 
This thread has become one of those things that drives a guy nuts but that guy just can't turn his head from it.

I'd rather see tcp's and sheds. I'd certainly share if I had any.
 
I don't know the guy, I talked with him a few minutes at the ATA show. My first impression of him I'll keep to myself.

Of the 5 people I know who have ever talked to or know him 4 of them plus myself and you and have the same first impression I'm sure.......I won't take anything away from the deer, he deserves respect but I'm not sure I can say the same for the hunter and yes I'm stereotyping from my first impression and nothing to do with this case....
 
All of this talk of jealousy and what not kind of aggravates me. Deer of this caliber are killed every year.

There are a couple lessons learned here about what not to do if you don't wan't your name dragged through the mud.

#1. Don't build a shooting tower next to a giant mineral lick.

#2. If your going to say you covered the site with a tarp, make darn sure the tarp is big enough!
 
Can I politely ask what the heck anybody's opinion of this guy has to do with the price of china? So since a few of you think he's a jerk, he deserved this? You do realize that when you qualify a statement with something like, "I'll keep my impression of him to myself", you've already said what you're insinuating, right? It wasn't just him and his name that got crapped on. Plenty of good (and when I say good, what I'm implying is that they're good people, based on impressions over the 10 or so years I've known them) were affected by this as well... Not to mention, the stain on our very own DNR's reputation.

Maybe I'm in the minority here but I just don't understand it. It's getting worse than a hair salon around here.
 
Lays out the states whole case, no more speculation about what went on, and why the state chose to take it to court.
 
From what I read the site was not 100 percent covered or removed according to Iowa law. In addition, both Franz and Wilkerson lied to CO's about total coverage, before the season, using both tarp and plywood, until confronted with the Oct 19 purchase of plywood; which was long after the hunt causing Franz to change his story. The state also questions whether the site was covered at all based on google earth photos from Oct 14, which were taken after the hunt. Why wait til October 1 to cover the site? Wasn't the farm bought in August. Also, his stand was within shooting range of at least one mineral site. Why not be safe and hunt away from the mineral site? It stinks IMO. This guy baited an Iowa giant and now has a site pimping the kill, and for a mere $2500 ,you too can have a set of replica antlers. This is every bit of what many on this site allegedly criticize. Oh, and please disregard the previous baiting conviction from a few years prior, mere coincidence.

You want to know what is wrong with deer hunting today? THIS right here is what is wrong with deer hunting today... the ability for people to sit and hide behind a keyboard and gossip about things they know nothing about, and for what gain? To slander somebody's name? To make themselves feel good? To bully with no repercussions? It sickens me.

I am Derek Wilkerson. I'm the guy who has had his name drug through the mud on this along with my good friend, Joe. I haven't said a word publicly about this since I was bombarded by law enforcement last September. What Joe and I have had to go through here... I don't wish it on anyone.

Imagine somebody showing up at your home on a Sunday night, interrogating you like a murder suspect for 3 hours, calling you a liar, trying to pin you down on things that occurred an entire year prior, then leaving.... accusing you of a crime you didn't commit, and then a week later come and charge you with a crime you didn't commit, and force you to fight with every breath to defend yourself for months against a crime you didn't commit.

Do you honestly think the prosecuting attorney's closing arguments are going to speak favorably towards me or Joe? They LOST the case! The judge saw right through their BS argument, and issued a not-guilty verdict. The statement the attorney issued above..... is false. That is not what happened, and the courts proved it. In fact, they looked like fools at the trial and didn't even issue a closing argument until WEEKS AFTER the trial. At the end of the trial, they had nothing, and asked the judge if they could issue a written brief instead of arguing the remainder of their case in court. It was a joke. Everyone there saw it was a joke. It was a waste of tax-payer dollars to be in that courtroom.

So for everyone on here that is so so quick to pass judgment on somebody without knowing ANY facts, I ask you why? What makes you so miserable with yourself that you have to judge others? We are all hunters here, and it makes me sad for my future children to live in the world of the internet and have to be subjected to the rash judgement from a hoard of keyboard cowboys with nothing better to do.

if you want facts, I suggest you get them straight from the horses mouth, and don't rush to pass biased judgements on people because you disagree with the way some people hunt. We filmed the hunt. It was an amazing deer and I bet every single one of you watched the video. You are on a website dedicated to promoting big bucks and deer hunting in Iowa, yet you judge somebody else who does the same? How about the pot calling the kettle black.... look in the mirror.

I can't stand reading the negativity in and amongst deer hunters in our great state. If somebody kills a deer, doe or buck, large or small, I'll be the first person to shake their hand and congratulate them. I suggest some of the members on here start doing the same, for your sake and that of the next generation.

From my standpoint this is a case that should have brought sportsmen and women together, instead of obviously separating the herd. I don't blame the DNR completely. They were issued a tip and as any law enforcement agent is supposed to, they followed up on that tip. I believe justice was served, but it's almost a too little too late scenario. Peoples names have been drug through the mud and the damage is done.
 
After reading the closing arguments, it appears as though the officers played their trump card too early. If they had waited until after the defense had testified, then brought out the purchase date for the plywood, the outcome might have been different. Giving the defendant time to come up with an alternate story was the downfall.

As stated before, not guilty does not mean innocent. Kind of like OJ :)

These guys knew what they were doing was questionable, hence, contacting the CO. They made a halfassed attempt to do it right but got caught. They're just thankful that the Jury was swayed to a little doubt about something

Gotta agree, it should have brought everyone together. Make the DNR come up with better regulations. Personally glad that he is innocent, glad he got his deer back, and hopefully I can shake his hand, and Wilkersons at the Classic.. I will be there all weekend setup, so I will be looking for ya Derek!
 
Derek you and Chris need to keep posting. You guys have always put out excellent stuff. Don't worry as there are many who are backing you. Google has created overnight law officers,lawyers,and many genius. If I didn't know any better I would think they have been watching to many Perry Mason reruns(google it). Gotta go I'm tracking a 4 wheeler trespasser with SCI ICU or something like that. Maybe I should use Google Earth. They update pics once a year.
